Expediting Permits

We provide proactive counsel to help obtain site plan and permitting approvals where development borders on protected buffer zones governed by the Massachusetts Wetlands Protection Act (MWPA), the Massachusetts Environment Protection Act (MEPA) the federal wetlands protection laws and regulations, and wetlands protection regulations of the DEP. Our aim is to expedite permitting where environmental impacts would be negligible, or where our clients have demonstrated plans to mitigate environmental impacts.

• Jeff Angley and his associates assist in submitting Notice of Intent (permit application) filings to the local Conservation Commission.
• If the Commission denies the permit or approves an Order of Conditions that places unduly harsh restrictions on development, we file an appeal for a superseding order of conditions to the DEP.
• Where a DEP upholds the order I, we appeal to a DEP administrative law judge (ALJ).
• If necessary, after the ALJ hearing, we take appeals to the Superior Court or the Massachusetts Appeals Court.
